Auto Accident Advice – Jacksonville, Florida

Last Dec. I was rear-ended on my way home from work.Was a $1,000 a week truck driver, now I walk with a walker. Can’t work, maybe have to have back operation. I get a little money from my own dis. ins but nothing from the driver at fault or my own ins. i had to file chapter 13 to keep my cars from being repo’ed. I am 58 and I live in Jacksonville Fla. Shouldn’t I be entitled to something besides measley dis. payments. The guy that hit me has Allstate and I have Hartford. Allstate says they are going to pay my lawyer $10,000 for PIP so I guess he will keep all of that. I ask but never get answers. I think I should get something for being permanently damaged. The dis. Ins. co says they will pay until I am 64 and I appreciated it but its not what I was earning and I won’t be putting anything away. I think I should at least get what I would have earned working. Thank you for any advice.

If allstate paid for your lawyer, the lawyer’s only supposed to get a percentage of that payment. NOT ALL OF IT. You need to contact that lawyer and if still no responses from him, turn him into the bar association. You should also check with a lawyer that specializes in what you’ve been through where he can make sure the person responsible for causing your injuries will pay or his insurance will pay YOU….not that lawyer. That lawyer sounds like he screwed you over big time. But like i said, he’s only allowed a certain percentage of any thing that Allstate gives for the wreck. Check your papers you signed with the lawyer to see what that percentage is. You may even have to end up taking HIM to court for not giving you what’s rightfully yours.
